Functions of the Speaker and Clerk

The Constitution provides that there shall be a Speaker for each House who shall be elected by that House in accordance with the Standing Orders.

The Speaker of the County Assembly shall have the following duties and responsibilities:-

01 The Speaker presides at every sitting of a House of County Assembly;

02 The Speaker of the County Assembly shall preside over all debates of the County Assembly and enforces the observance of the Constitution, the Standing Orders, relevant statute and Assembly traditions, procedures and practices;

03 The Speaker administers the oath of affirmation or allegiance to Members and issues writs for vacant County Assembly seats;

04 The Speaker protects the rights of the minority while making sure that the majority have their way;

05 Organizing the business of the House as he/she is the Chairman of the House Business Committee;

06 Spokesperson of the County Assembly and shall ensure that the dignity of the County Assembly and by extension, Assembly, is upheld and its rights and privileges are not abused;

07 The Speaker is the final authority on all matters touching on the interpretation and application of the practice and procedure of Assembly at all times.

The Clerk is the only non-elected person who regularly speaks in the Assembly. The Clerk of the House is the administrative and procedural head of the Assembly and oversees the day to day operations and affairs of the Parliament. The Clerk is assisted by the Deputy Clerk and Clerk Assistants.

The Clerk has several responsibilities in the County Assembly including:

01 Assisting the Speaker to run the house proceedings including having thorough knowledge of the rules of the House and tabling all documents presented to the house

02 Helping the Speaker and Members of the Assembly to organize the order of business including providing advice on house Procedure

03 Drafting private members bills and amendments

04 Certifying the passage of bills through the Assembly

05 Assisting with ceremonial occasions, such as the opening of Assembly and is required tom swear an oath of allegiance administered by the Speaker of the House to new Members of County Assembly

06 Pursuant to section 12 (1) of the County Governments Act 2012,The Clerk of the County Assembly is the secretary of the County Assembly Service Board

07 He is the accounting officer of the County Assembly
